Wills – Many people think they don’t need to make a Will. After all, you might reason that if you die, whatever money and property you have will automatically go to your next of kin, right? Unfortunately, matters can be more complicated than that if someone hasn’t written a Will.
The United Kingdom has intestacy laws that determine how to distribute an estate for which a proper Will was not written. In effect, your estate could go to relatives that you haven’t seen in years or don’t even like!
Making a Will is a good idea for almost everyone, but it should be considered essential for anyone who has children. What will happen to your offspring if you and your partner were to die together in an accident? Setting up guardianship and putting financial provisions in place for your youngster’s upbringing is imperative. In addition, for those who own property, investments and maybe a business, creating a Will helps stop any disputes that could break out after your death by making your wishes totally clear.
Trusts – A Trust is a way of ring fencing and managing assets (money, investments, land or buildings) for people.
Trusts are set up for a number of reasons, including:
· To control and protect family assets.
· To manage assets for someone who is too young to handle their own affairs.
· To manage assets for someone who is vulnerable due to health or addiction issues.
Lasting Powers of Attorney – Whilst Wills are used to deal with your belongings and estate when you die, Lasting Powers of Attorney (or LPAs) are documents used to make life easier for you and your loved ones. They are tools used to assist you if you lose mental capacity or physical ability, either due to an accident or deteriorating health.
A Lasting Power of Attorney is often set up alongside a Will, but the two do not necessarily need to be created together.
